ACA 5 is a proposed constitutional amendment that removes from the state Constitution Proposition 8 language establishing marriage as a union between one man and one woman. This text was put into the state constitution by California voters in 2008, but was later declared unconstitutional by federal judges. This bill has no legal effect, but it gives those promoting same-sex marriage a platform to promote their definition of marriage, and pressure Christians, conservatives, and Republicans to abandon their commitment to traditional/biblical marriage.

If passed, this issue will be placed on the 2024 November ballot for voters to decide.
